PollKhol ("we," "us," "our," or "Company") reserves the right to modify these Terms at any time. Changes will be effective upon posting, and your continued use of the Service constitutes acceptance of the modified Terms.

By downloading, installing, accessing, or using the PollKhol mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Eligibility and Account Registration

We collect information to provide a better experience for all our users. The types of information we collect include:

1.1 Age Requirement

• You must be at least 13 years old to use PollKhol (or the legal age of digital consent in your country)
• Users under 18 must have parental/guardian consent

1.2 Account Registration

• You must provide accurate, truthful information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You agree not to share your account with others or allow unauthorized access
• You are liable for all activity on your account

1.3 Account Termination

We may suspend or terminate your account at any time for:

• Violating these Terms
• Engaging in illegal or harmful behavior
• Violating user conduct policies
• Inactivity (at our discretion)

2. User Conduct and Acceptable Use

2.1 Prohibited Conduct

You agree NOT to:

• Violate any local, state, national, or international law
• Engage in fraud, deception, or harassment
• Attempt to gain unauthorized access to the Service
• Post abusive, defamatory, hateful, or threatening content
• Create content that discriminates based on race, religion, gender, sexual orientation, disability, or caste
• Incite violence or illegal activity
• Post sexually explicit or obscene content
• Share personal information of others without consent (doxxing)
• Create multiple accounts to artificially inflate votes or manipulate polls
• Engaging in illegal or harmful behavior
• Violating user conduct policies
• Use automated tools, bots, or scripts to access the Service
• Engage in vote manipulation or brigading
• Post spam, promotional content, or MLM schemes
• Attempt to bypass content moderation systems
• Infringe on copyrights, trademarks, or patents
• Post content you don't have the right to share

2.2 Content Moderation

• We reserve the right to remove content that violates these Terms
• Poll requests may be placed in review for content moderation before going live
• We may flag, hide, or delete polls, ratings, or requests without notice
• Repeated violations may result in account suspension or termination

3. User Content

3.1 Ownership

• You retain ownership of content you create (polls, ratings, requests, feedback)
• By submitting content, you grant PollKhol a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display your content for service improvement and analytics

3.2 No Endorsement

• Content posted by users does not represent the views, opinions, or endorsement of PollKhol
• We are not responsible for user-generated content

3.3 Responsibility

• You are solely responsible for content you post
• You agree to indemnify and hold PollKhol harmless from any claims related to your content

4. Poll Integrity and Voting Rules

4.1 One Vote Per Poll Per User

• Each user can vote only once per poll
• Attempting to vote multiple times is a violation and may result in:
  • Vote removal
  • Account suspension
  • Permanent ban
• Cloud Functions (Google Cloud): Our backend services process votes and requests
• Google Sign-In: For user authentication only

4.2 Poll Request Limits

• Users are limited to 2 poll requests per day
• Poll requests undergo content moderation before becoming live
• Communities vote on poll requests using upvotes/downvotes
• Polls are created based on community demand and platform guidelines

4.3 Voting Transparency

• Poll results (aggregate votes) are public and transparent
• Individual voting patterns are private and not disclosed
• We do not share which user voted for which option

5. Ratings and Reviews

5.1 Rating Politicians

• Ratings must be based on genuine opinion
• Ratings are restricted to a scale of 1-5 stars
• You may only rate each politician once (updates allowed)
• Ratings are public and cannot be anonymous

5.2 Misuse

• Coordinated rating attacks or brigading will result in:
  • Removal of fraudulent ratings
  • Account suspension or termination
  • Potential legal action if illegal

6. Notifications and Communications

6.1 Notification Opt-In

You consent to receive push notifications about:

• New polls
• Daily digests
• Poll request status updates
• App updates and important announcements

6.2 Contact Information

• We may contact you via email for account-related matters, policy violations, or security issues
• You agree to receive these communications

7. Intellectual Property Rights

7.1 Company Content

• All content owned by PollKhol (logos, design, code, text) is protected by copyright and intellectual property laws
• You may not reproduce, distribute, or modify our content without permission

7.2 User Content License

• By uploading content (polls, ratings, feedback), you grant us a perpetual, irrevocable license to use it for analytics, moderation, and service improvement

7.3 Third-Party Content

• The Service may include content from third parties
• We are not responsible for third-party content

8. Disclaimers and Limitations of Liability

8.1 "As-Is" Service

The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis. We make no warranties, express or implied, regarding:

• Accuracy of poll results
• Availability or uninterrupted access
• Suitability for a particular purpose
• Freedom from errors or bugs

8.2 No Liability for Poll Results

• PollKhol is not liable for any decisions made based on poll results
• Poll results reflect user opinions only and do not represent facts or endorsements
• We do not guarantee poll accuracy or representativeness

8.3 Limitation of Liability

To the maximum extent permitted by law, PollKhol shall not be liable for:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, or profits
• Service interruptions or downtime
• User content or third-party conduct

Total Liability Cap: Any liability is capped at the amount you paid to use the Service (typically $0 for free users)

8.4 Indemnification

You agree to indemnify and hold harmless PollKhol, its officers, employees, and agents from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the Service
• Your user content
• Your conduct

9. Privacy and Data Protection

• Your use of the Service is governed by our Privacy Policy
• We comply with applicable data protection laws including India's Digital Personal Data Protection (DPDP) Act, 2023
• We do not sell user data to third parties

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service meets your expectations
• Poll results are accurate or representative

11. Termination and Survival

11.1 Termination by You

• You may terminate your account anytime
• Your data will be deleted within 30 days (as per our Privacy Policy)

11.2 Termination by Us

• We may suspend or terminate your account for violations without notice
• We may terminate the Service with 30 days written notice

12. Changes to Terms

We reserve the right to modify these Terms at any time. We encourage you to review this page periodically for any updates. The date of the last update will be indicated at the top of this terms.

Continued use of the Service after changes constitutes acceptance. If you do not accept the new Terms, you must stop using the Service and request to delete your account.
